LEGAL NOTICE
Incorporated Village of Stewart Manor Zoning Board of
Appeals, Notice of Public Hearing. Notice is hereby given that a hearing before
the Zoning Board of Appeals of the Incorporated Village of Stewart Manor, New
York is scheduled for Monday, April 19, 2021 at 7:00 pm at the Village of
Stewart Manor, 120 Covert Avenue, Stewart Manor, NY 11530 or via Zoom video
conference if permitted by an extension of NYS Executive Order No. 202.1. If
the meeting is held via Zoom video conference, the information will be posted
at least 48 hours prior to the meeting on the Village’s website and on a note
on the door of the Village Hall. The following request for a variance will be
heard: The first applicant, Mr. Peter
Healy at 97 Elton Road is proposing
to remove the attached south side
1 car garage and construct a roughly 555 sq. ft. one story south side/rear
addition. Roughly 125 sq. ft. of the 555 sq. ft. will be utilized for storage
with the remainder as living space. 2 central AC units are proposed on the north
side where 3.5 feet is the required minimum and the units would be 3'3"
from the north side property line. He is seeking variances from Sections:
200-41G.: Outdoor compressors, Section:
200-13.: Height and Bulk; Schedule. (Rear & Side Yard). The variances sought
are: 1) 3 inches for the 2 AC units to the north side lot line. 3’3” proposed,
3’6” required, 2) 10 feet to the rear lot line from the rear 1 story addition,
3) 2 feet in the south side yard for the 1 story addition. The second applicant, Mr. Louis Margro at
66 Fernwood Terrace is proposing add a 115 sq. ft. roof over the
existing front raised terrace, to remove and rebuild the attached 1 story north
side 1 car garage as part of a 783 sq. ft. 2 story north side/rear addition. A
portion of the driveway (28") will be extended into the front of the
dwelling requiring a variance for parking in front of the dwelling. He is
seeking variances from sections: 200-42.: Approved Parking Areas, Section 200-13.:
Height and Bulk; Schedule (Side & Front Yard & Aggregate). The
variances sought are: 1) 3 feet in the north side lot line to rebuild
the garage and a portion of the 2- story rear addition. 3' proposed, 6'
required, 2) 5 feet for the 2-story rear addition to the north side lot line, 3)
Parking in front of the dwelling, 4) 6 feet for the total aggregate. 12 feet
proposed, 18 feet required, 5) 1.02 feet for the front roof over the existing
terrace. 34.75 feet is the proposed setback and 35.77 is the average front yard
setback.
The applications and accompanying exhibits
are on file and may be inspected at the Village Office during normal business days
between 9 a.m. and 4 p.m. by appointment only. At said hearing, all parties and interests will
be given an opportunity to be heard.
