Legal Notice of a ZBA Hearing on July 20, 2020

Incorporated Village of Stewart Manor Zoning Board of Appeals, Notice of Public Hearing. Notice is hereby given that a hearing before the Zoning Board of Appeals of the Incorporated Village of Stewart Manor, New York is scheduled for Monday, July 20, 2020 at 7:00 pm at the Village of Stewart Manor, 120 Covert Avenue, Stewart Manor, NY 11530 or via Zoom video conference if permitted by an extension of NYS Executive Order No. 202.1.  If the meeting is held via Zoom video conference, the information will be posted at least 48 hours prior to the meeting on the Village’s website and on a note on the door of the Village Hall. The following requests for variances will be heard: The first applicant, Mr. John O’Donnell at 37 Stewart Avenue, in a continuation of the June 15, 2020 hearing, is proposing to convert the existing attached garage to living space and maintain the existing 2nd floor kitchen to be used by a family member. He is seeking variances from Section: 200-22.: Permitted Uses in Residential District; Restrictions, Section: 200-43A.: Required Number of Spaces, Section: 200-4C Approved Parking Areas. The variances sought are: Use variance for the 2nd above grade kitchen; 1 off street parking space; and parking in front of the dwelling. The second applicant, Mr. Yildiz of DY Tulip LLC, 600 Tulip Avenue, Floral Park, NY 11001, is proposing to remove the use as a mechanics shop and a portion of the existing building and renovate the remaining 30.39’ x 40.5’ (1,231 sq. ft.) to operate the property as a retail convenience store and gas station. The original application indicated 14 parking spaces. To operate the convenience store would require 8 parking spaces and the applicant did indicate 8 parking spaces on the June 15, 2019 application but the applicant later revised the application indicating 4 parking spaces therefore, a Zoning Variance for 4 parking spaces would now be required. He is seeking a variance from Section: 200-43.D.3: Required Number of Spaces (Parking) (ZBA).  The variance sought is: 4 Parking Spaces in the Business Zone. The applications and accompanying exhibits are on file and may be inspected at the Village Office during normal business days between 9 a.m. and 4 p.m. by appointment only. At said hearing, all parties and interests will be given an opportunity to be heard.
